BLOG NUMBER 5.38
On May 21, 2015, the Madison-St. Clair Record published a story about a truck driver suing his trucking company. What was his complaint? On February 12, 2014, truck driver Charles Robinson slipped and fell on an icy sidewalk. His injuries included multiple fractures that required surgery.
According to the Madison-St. Clair Record, a legal journal, Robinson is suing for more than $50,000 in damages. Robinson is also suing for legal fees.
Accident vs. Negligence
When reading this article, a number of questions come to mind. Questions such as:
- Was it just an accident, or was it really negligence?
- How much liability does a business have when it comes to weather conditions?
Mr. Robinson claims that he went in one door to take in some paperwork to his employer and then exited using a different door. Outside this door on the ground was an accumulation of ice. The ice accumulated in that spot because the water from a downspout drained directly onto the sidewalk. Had the company taken preventive action, argued Robinson, the ice never would have been there and the accident never would have happened.
